Information We Collect

We might receive and collect the following information about you while you use our services: your name, email, phone number(s), address, the last four digits of you social security number, credit card number if you provide it, date of birth, employer information and income figures if you provide them, current loan/credit information, and vehicle information (“Information”). You may provide this Information when yougo through our loan application process; sign up for other products or services through Pacecar; when you provide Information to us through a third-party application, service or website; when you communicate with us regarding our services through email or other means; or when you participate in any of our marketing initiatives

Use of Collected Information

Pacecar uses Information to provide the products and services you requested; provide you customer support; research and analyze other products and services that may save you money offered by Pacecar or others; to communicate with you via telephone, mobile devices, email or postal mail about products or services; to deliver relevant advertising; to analyze the effectiveness of Pacecar advertising and other efforts; and to otherwise conduct our business. In addition, we may disclose the information we collect as described above to companies that perform marketingservices on our behalf, with which we have joint marketing agreements, or with which we have other agreements that among other things require the safeguarding of your Information.

Links within the Pacecar site may take you to third party sites that are governed by their own privacy policies. When you use links to visit these sites, Pacecar’s privacy policies are no longer valid.

Pacecar and Affiliates: We may share your Information with Pacecar subsidiaries andaffiliates. These subsidiaries and affiliated adhere to this Privacy Policy.

Lenders: Once you have submitted your information, Pacecar will begin the process of finding you the best possible interest rate from our lender base. Your Information is not sent to each lender in our network for review. Instead, your credit profile and needs are matched to the borrower profile established by our lenders and sent to those lenders first. By submitting an application to Pacecar, you consent to the use of your credit report for the purpose of obtaining a credit offer from one of our participating lenders.

To Comply with the Law: We may disclose Information we collect if we determine in our sole discretion that such disclosure is necessary to comply with the law, including disclosure to law enforcement agencies and other government agencies and disclosure responsive to subpoenas. We also may disclosure information we collect if we deem it necessary to protect the rights, property, or safety of Pacecar, our customers or others.

To Third-Parties: We may disclose your information to third party vendors that provide services to Pacecar to process your information for purposes of reviewing your loan application. Also, Pacecar may disclose your Information to third parties that are interested in contacting you or providing offers to you that may be related to our products and services or about products or services you may find of interest, and we may be compensated for such disclosure.

You can, at any time opt-out of our ability to share Information with unaffiliated third-parties that do not provide services to Pacecar for processing your loan application by contacting customer service at support@pacecar.com.

The Use of Cookies

Pacecar uses cookies to store a unique user identifier (i.e. your user name). A cookie is a small data file that contains information such as a user ID. The data is written toyour hard drive and is accessed each time you visit the site. Although, the only personal information a cookie can record is information you supply yourself, Pacecar uses this ID to identify you anonymously in our database. The cookie is also required to reach certain parts of the Pacecar site and is used to personalize the site for you. A cookie cannot read data off your hard disk or read other cookie files created by other sites that you visit.

We maintain physical, electronic, and procedural protections that comply with federal and state laws to safeguard your personal information. Because we recognize the importance of privacy where children are involved, we do not knowingly collect information from children.

Options Regarding the Collection, Use and Distribution of Your Information

It is important to remember that you have absolute control over the amount of personal information collected on this site. When you click on “Next” at each step inthe process, you affirmatively consent to Pacecar’s collection of Information for the application process.As Pacecar develops, it may sell or purchase other companies and/or assets. In such transactions, customer information is generally included in the transfer of business assets. In the unlikely event that Pacecar or substantially all of its assets are acquired, customer information will be one of the transferred assets.

Amendments

Requirements for your application to be considered by Pacecar:

You must be 18 years old or older. Your current loan must have a balance of $7,500 or greater. Your vehicle must be no older than 10 years. Vehicle must have less than 150,000 miles. Your combined household income must be $2000/mo. or greater.

By submitting your information through Pacecar, you represent that you have read, understand, and agree to these Terms of Use. If a joint application is filed, these Terms of Use apply to each of the applicants equally:

You represent that the information that you have provided in this process is true and complete, and that you are over the age of 18 and have the power and authority to enter into and perform your obligations under any credit arrangement that may be offered;

You acknowledge that you may withdraw your interest at any time prior to executing any loan agreement;

You authorize Pacecar to pull your credit report for the purpose of evaluating your credit options for financing your loan through Pacecar’s network of lenders, lending partners, and third-parties ("Network");

You consent to the sharing of the information you have provided with one or more parties in the Network;

You authorize any party in the Network, to which Pacecar has submitted your information, to pull your credit report in order to evaluate your creditworthiness;

You acknowledge that Pacecar and any party in the Network may retain your information in order to comply with certain federal and state laws and regulations;

You acknowledge that you have read the Pacecar Privacy Policy;

You acknowledge that Pacecar does not guarantee that a lender will make you an offer to finance your loan;

You acknowledge that Pacecar does not guarantee that a lender will finance your loan at specific terms and conditions, including a specific interest rate;

You acknowledge that Pacecar is not responsible for any errors or delays related to your application caused by incorrect information provided by you or other technical problems beyond its reasonable control;

You may consent to receive notices electronically and agree to receive such notices at Pacecar's website. These notices may include privacy notices and information required by the Equal Credit Opportunity Act;

You acknowledge that the services offered by Pacecar are available only to residents of, or secured by collateral located in, those states where Pacecar is licensed (if licensing is required) and those states where any party in our Network are licensed or authorized to make such loans;

You acknowledge that under no circumstances will Pacecar be liable to you or to any other person for any indirect, incidental, consequential, or punitive damages arising out of or relating to this agreement. Your sole and exclusive remedy hereunder will be for you to discontinue your use of our services and terminate this agreement; and

You acknowledge that this agreement shall be subject to the laws of the California, excluding its conflict of law principles.

CUSTOMER COMMUNICATIONS: By accepting these Terms of Use, you expressly consent to be contacted by Pacecar, its agents, representatives, affiliates, or any party in the Network for any and all purposes related to your application and any related loan, at any telephone number, or physical or electronic address you provide or at which you may be reached. You agree that Pacecars, its agents, representatives, affiliates, or any party in the Network may contact you in any way, including SMS messages (including text messages), calls using prerecorded messages or artificial voice, and calls and messages delivered using auto telephone dialing system or an automatic texting system. Automated messages may be played when the telephone is answered, whether by you or someone else. In the event that an agent or representative calls, he or she may also leave a message on your answering machine, voice mail, or send one via text. You consent to having all calls between you and Pacecar recorded for quality assurance. You consent to receive SMS messages (including text messages), calls and messages (including prerecorded and artificial voice and autodialed) from Pacecar, its agents, representatives, affiliates or party in the Network at the specific number(s) you have provided to Pacecar, or numbers it can reasonably associate with your account (through skip tracing, caller ID capture or other means), with information or questions about your application, loan and/or account. You certify, warrant and represent that the telephone numbers that you have provided to Pacecar are your numbers and not someone else's. You represent that you are permitted to receive calls at each of the telephone numbers you have provided to us. You agree to alert Pacecar whenever you stop using a particular telephone number. You also understand that your cellular or mobile telephone provider will charge you according to the type of plan you carry.

CONSUMER NOTICES BY STATE

Notice to California Residents: If married, you may apply for credit separately as an individual.

Notice to New York Residents: Consumer reports may be requested in connection with this application. Upon request, you will be informed whether or not a consumer report was requested and, if it was, of the name and address of the consumer reporting agency that furnished the report. Additional consumer reports may be requested with respect to any extension or renewal of this obligation.

Notice to Ohio Residents: The Ohio laws against discrimination require that all creditors make credit equally available to all creditworthy customers, and that credit reporting agencies maintain separate credit histories on each individual upon request. The Ohio Civil Rights Commission administers compliance with this law.

Certain laws require Pacecar Inc. (hereinafter, “Pacecar,” “we,” “us,” “our”) to provide certain account information to you. We may provide such information to you electronically if we obtain your consent to receiving electronic communications in accordance with this E-Communications Disclosure. You are required to consent to receiving E-Communications to establish a customer relationship with Pacecar and/or submit financing requests through us.

• Your Consent to Receive E-Communications. By opening a Pacecar account, submitting any loan application through Pacecar’s website and accepting this E-Communications Disclosure, you consent to receiving electronic communications, which include any disclosure, notice, agreement, statement, schedule of fees, explanation of services, inquiry responses, or any other communication regarding any application, account, product or service provided to you, directly or indirectly, by Pacecar for the duration of your use of Pacecar services (collectively, “E-Communications”). From time to time, E-Communications may include notices from Pacecar partners you contact via the Pacecar services.
• Email Addresses/Mobile Devices. You agree that we may provide E-Communications to you via email, or by posting them to the Pacecar website (“Website”). E-Communications sent via email will be delivered to the email address registered to your Pacecar account. If an E-Communication is sent via email and is returned as undelivered, we may use any other email address that we have for you. You must notify us of any change in your email address by updating your Pacecar account. Unless otherwise required by law, you agree that any E-Communication will be deemed received by you when sent by any means set forth above.
• Withdrawal of Consent. You may withdraw your consent to receive E-Communications by contacting Pacecar using the Customer Service function on the Website. The withdrawal of your consent to E-Communications will result in the immediate closing of your Pacecar account and cessation of all related Pacecar Services.
• Printed Copies. You may use the Customer Service function on the Website to request a paper copy of any communication provided electronically. There will be a $5.00 processing fee for each request for paper copies. Your request for a paper copy of any E-Communication will result in the immediate closing of your Pacecar account and cessation of all related Pacecar services.
• System Requirements. In order to properly access and retain your E-Communications you must have (i) a personal computer (with monitor) or mobile device capable of accessing the Internet, displaying visual content, and sending and receiving emails; (ii) access to a printer capable of printing copies of emails or Website content for your records (if you desire paper records); (iii) sufficient computer or mobile device hard drive, or cloud-based storage capability, capable of storing data, if you wish to store E-Communications; (iv) an Internet browser that supports PCI-compliant standards, which at the time of this writing means TLS 1.2 or above for communication with the web server; and (vi) a software program that accurately displays PDF files. For E-Communications provided in PDF format, Adobe Acrobat Reader 6.0 or later versions is required, a free copy of which may be obtained from the Adobe website at www.adobe.com. If any of the above system requirements change, and we believe that such change may create a material risk that you will be unable to access E-Communications, Pacecar will notify you of the new hardware/software requirements.

Rights for California Residents:

If you are a California resident you may have certain rights under the California Consumer Privacy Act (Cal. Civ. Code §1798.100 et seq.) regarding your personal information, including:

Pacecar Inc. does not offer an opt-out from the sale of personal information because Pacecar Inc. does not engage in the sale of personal information as contemplated by the CCPA. While we often benefit from such exchanges, we do not share personal information for the sole purpose of receiving compensation for that information.
